Die SPD will das Leistungsschutzrecht verhindern – mit einem faulen Kompromiss
Heute legen die von der SPD geführten Bundesländer Nordrhein-Westfalen und Rheinland-Pfalz eine Alternative zum Regierungs-Entwurf für ein Leistungsschutzrecht vor. Doch wie gut haben sie sich das überlegt?
Die SPD sitzt gern zwischen den Stühlen. Einerseits ist sie gegen das von der schwarz-gelben Koalition geplante Leistungsschutzrecht, andererseits möchte sie die Verleger auch nicht völlig vergraulen.
Also hat sie sich einen Kompromiss ausgedacht. Die SPD-geführten Länder NRW und Rheinland-Pfalz bringen heute im Rechtsausschuss des Bundesrates einen Antrag ein, der den Verlegern künftig ein selbstständiges Klagerecht gegen die unerlaubte Übernahme von Inhalten zugesteht.
Nach geltendem Urheberrecht ist es nämlich (theoretisch) so, dass die Presseverlage immer das Einverständnis der Urheber zur Rechtsdurchsetzung brauchen und dieses gegebenenfalls nachweisen müssen. Sonst können sie nicht gegen Rechtsverletzer vorgehen. In der Praxis ist es allerdings so, dass die meisten Urheber - aufgrund ihrer schwachen Vertragsposition - dieses Einverständnis vertraglich längst gegeben haben.
Die Ländervertreter der SPD schlagen nun vor, den Verlagen mit Hilfe einer so genannten Vermutungsklausel ein eigenes Klagerecht zu verschaffen. Das würde bedeuten, dass man künftig stillschweigend davon ausgehen würde, dass die Verlage auch über die nötigen Rechte verfügen.
Die SPD-geführten Länder halten diesen Kompromiss offenbar für vertretbar, wenn man durch ihn das umstrittene Leistungsschutzrecht verhindern könnte.
Doch der Preis für die Urheber wäre nach unserer Meinung zu hoch. Die Autoren würden ein Recht abtreten, ohne dafür etwas zu bekommen. Sie könnten a) selbst nicht mehr gegen Rechtsverletzungen vorgehen (wenn der Verlag schon tätig geworden ist) und b) käme es immer wieder zu der unangenehmen Situation, dass Menschen im Namen des Autors verklagt würden, gegen deren Handlungen der Autor gar nichts einzuwenden hat (etwa auszugsweiser Nachdruck eines Artikels). Außerdem ist völlig ungeklärt, ob der Autor vom eingeklagten Geld etwas abbekommt.
Also, liebe SPD, noch mal scharf nachdenken!
